Course Outline

These sections of the Texas Government Code and Texas Education Code apply to license holders.

  • Government Code §411.2031:
    • Allows LTC holders to carry a concealed handgun on the campus of an institution of higher education or private or independent institution of higher education in Texas.
    • Requires the president or other chief executive officer of an institution of higher education in Texas to establish reasonable rules, regulations, or other provisions regarding the carrying of concealed handguns by license holders on the campus of the institution or on premises located on the campus of the institution.
    • Does not allow the president or other officer to establish provisions that generally prohibit or have the effect of generally prohibiting license holders from carrying concealed handguns on the campus of the institution UNLESS it is a private or independent institution of higher education that has established rules, regulations, or other provisions prohibiting LTC holders from carrying handguns:
      • On the campus of the institution or…
      • On any grounds or in any building on which an activity sponsored by the institution is being conducted or…
      • In a passenger transportation vehicle owned by the institution.
  • Government Code §411.2032 prohibits an institution of higher education or private or independent institution of higher education from prohibiting an LTC holder, including a student at the institution, from storing or transporting a firearm or ammunition in a locked vehicle:
    • On a street or driveway located on the campus of the institution or…
    • In a parking lot, parking garage, or other parking area located on the campus of the institution.
  • Education Code §37.0815(a) states that a school district or open-enrollment charter school:
    • May not prohibit a person with a valid LTC, including a school employee, from storing a firearm or ammunition in a locked vehicle in a parking lot, parking garage, or other parking area provided by the district or school and...
    • May not regulate the way the firearm and ammunition are stored in the vehicle provided that the firearm or ammunition is not in plain view.
